Obsyra Terms of Use

These terms govern the use of "Obsyra," our exam-monitoring and integrity feature (the "Feature"). They apply both to organizations that enable the Feature to administer exams (the "Administering Company") and to individuals who take an exam while the Feature is active (the "Candidate"). A Candidate is deemed to have agreed to these terms upon starting a monitored exam.

1. Nature of the Feature

The Feature is a supporting mechanism that helps preserve the fairness of online exams. It does not judge pass/fail on the basis of any single action or signal. Instead, it combines multiple weak signals into a weighted risk score and, where appropriate, prompts human review.

• By default, the Feature does not automatically disqualify a Candidate. Final decisions are made by the Administering Company after human review.
• It does not perform facial recognition matching or cross-reference against third-party data.
• Detection has limits. It cannot fully detect misconduct that the system cannot observe, such as consulting another device or copying to paper.

2. Candidate Obligations

During a monitored exam, a Candidate must not:

• Have someone else take the exam, impersonate, or otherwise let a person other than the Candidate take it;
• Use materials, devices, or assistance from third parties that are not permitted for the exam;
• Take the exam using automation tools, headless browsers, or other automated operation;
• Copy, record, export, or share the exam questions; or
• Attempt to evade, obstruct, or tamper with the monitoring and recording.

3. Monitoring and Recording

Depending on the monitoring level chosen by the Administering Company (record-only, warning, full-screen lockdown, auto-terminate, etc.), the Feature records information about interactions during the exam. Where configured by the Administering Company, it may capture and store facial images via webcam. The content and handling of the recorded/captured information are governed by the separate Obsyra Privacy Policy.

The Feature is enabled at each tenant (Administering Company) at its option and is disabled by default.

4. Nature and Limits of Assessment

• Risk scores and detection results are probabilistic and do not guarantee accuracy or completeness; false positives and misses may occur.
• Detection results are reference information for selection and do not by themselves determine pass/fail.
• The final evaluation of a Candidate and the use of records are the responsibility of the Administering Company.

5. Disclaimer

We do not warrant that the Feature will detect all misconduct or that no false positives will occur. To the extent permitted by law, we are not liable for results arising from use of, or inability to use, the Feature. The Administering Company shall use the Feature in compliance with applicable laws (including those on personal-data protection, labor, and hiring).

6. Personal Information

Handling of personal information collected through use of the Feature is governed by the Obsyra Privacy Policy.

7. Changes to These Terms

We may revise these terms as necessary and will provide notice of material changes by appropriate means.
